It is important, and it is now mandatory that employers know that employees who work alone, are safe. The Corporate Manslaughter and Corporate Homicide Act 2007 states ‘...an organisation is guilty of corporate manslaughter if the way in which its activities are managed or organised causes a death and amounts to a gross breach of a duty of care to the person who died...’ It is important that employees and contractors have rated lone worker protection in case they are in trouble, and have assurances that aid on the road. There are a number of areas where health and safety legislation sets out requirements that must be met for anyone working alone. These include: - the obligation to provide adequate supervision; - "due diligence" obligation to take all steps reasonable in the circumstances for the protection of a worker; - Obligations of employers and supervisors to advise a worker of a hazard; - Specific requirements for certain tasks, such as diving or confined space entry, which have explicit requirements for the number of people whose presence is required,
The definition of "circumstances" can be done in a standard way and organized by the analysis of risk factors associated with the job alone. These factors include: - The time and distance the employee from sources of help in an emergency; - The length of time the worker is out of touch with supervision; - The degree of access to communication; - The presence of the hazards associated with the work done, and - The presence of the hazards associated with the environment in which work is done.
The HSE and HSENI have issued guidance in relation to lone workers. Failure to risk assess and resultant injury could attract liability under the Corporate Manslaughter legislation and under the new Health and Safety Offences Act 2009 which permits the sanction of imprisonment under 16 sections (formerly 2 sections) of the Health and Safety at Work Act 1974 and the Health and Safety at Work NI Order 1978.
