This Privacy Policy applies to www.trackn.me and www.trackn.co.uk (“TrackN” or “Site”) and governs data collection and usage including the Site and email services. This Privacy Policy does not apply to other web sites to which we link. You agree that your use of the Site signifies your assent to this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Site. TrackN and Quickin Ltd, are registered under the Data Protection Act 1998 under registration number _____________. Please note that your Information will be stored and processed on our computers in the UK. TrackN will use reasonable endeavours to hold and transmit your Personal Information in a safe, confidential and secure environment. Information We Collect TrackN collects both personal and non-personal information using the methods listed below. Our primary purpose in collecting such information is to provide you with a personalised online experience by displaying content and delivering offers that are likely to be of interest to you according to your preferences. If you choose not to register or not provide personal information, you may still visit the Site but you will not be able to access the restricted areas available to registered User and Customers. By completing the registration process, you accept the Terms and Conditions described and consent to our using your information accordingly. Information Collected at Registration To use the services offered by TrackN, you must register for our service and become a TrackN Member. TrackN collects personal information when you register with us and when you use TrackN services. During registration, we require Customers to give us basic contact information (“Personal Information”) (such as your first name, last name and e-mail address) and demographic information (such as your post code, age and gender). Under some circumstances we may require some additional financial information, such as, but not limited to credit card details, PayPal account details, bank account number for direct debit through PayPal Pro, or registering to buy on our Site. We use this financial information, to verify your name, address, and other information, as well as to bill you for your use of our services. If you send us personal correspondence over and above the information supplied on registration, such as emails or letters, or if other User and Customers or third parties send us correspondence about your activities or postings on the Site, we may collect such information into a file specific to you. The registration form information requests may change from time to time. Although additional demographic information may be requested at the time of registration, only information marked "required or mandatory " is necessary for registration and utilisation of our services. Once you register with TrackN, you are not anonymous to us. If you register for TrackN on another web site or use a web site providing a service for TrackN or a web site that helps facilitate your activity on TrackN , that web site may provide personal information about you and your transactions back to TrackN . The Site utilises a standard technology called "cookies" and web server log files to collect information about how our Site is used. Information gathered through cookies and Web server logs may include the IP address, browser types, date and time of visits, the pages viewed, time spent at our Site, and the web sites visited just before and just after our Site (“Website Information”). Our Use of Your Information We may occasionally use your name and email address to send you notifications and updates about your orders, by email, regarding new services offered by us that we think you may find valuable. Please note that Personal Information is used only to provide you with a more enjoyable, convenient online experience and to help us identify and/or provide information, products or services that may be of interest to you. We use your Personal Information to support and enhance your use of the Site and its features. We may permit certain trusted third parties to track usage, analyse data such as the source address that a page request is coming from, your IP address or domain name, the date and time of the page request, the referring web site (if any) and other parameters in the URL. SMS/ Email/ Newsletter Opt-out If you no longer wish to receive our SMS, emails or e-newsletter you may opt-out of receiving them by actioning the ‘opt out’ option located at the bottom of each email and/or e-newsletter. However, we reserve the right to send you notices even if you opt out of all voluntary email notifications. TrackN sends alerts (SMS or email) from the TrackN online platform defined by the user as SMS text, email or both. User must enable messages to be received through firewalls or filters. If user is is unable to receive messages due to firewalls or filters, TrackN is not responsible or liable for any loss of data or information on the End-User. Alerts include: Auto Alerts, battery status, geoleash, geofence, speeding and other location based responses. Cookies We use "cookies". A cookie is a small piece of data stored on the User and Customer's computer. We use cookies to identify the Internet browser, store User and Customer s’ preferences, and determine whether the correct software needed to access certain material on the Site has been installed. Data in cookies may also be read to authenticate User and Customer sessions or provide services. Third party advertisements displayed on the Site may also contain cookies set by advertising companies or advertisers (known as “third party cookies”). We do not control these third party cookies and User and Customer s of the Site should check the privacy policy of the Internet advertising company or advertiser to see whether and how it uses cookies. You can remove or block cookies using the settings in your browser. However, by blocking all cookies you may not have access to certain features on the Site. We may use cookies and similar tools to customise the content and advertising you receive based on the Personal Information and Website Information you have provided. The information used for this feature does not provide your Personal Information or identify you as an individual to third parties, but will involve the processing of certain Website Information such as IP addresses. Disclosure of Information TrackN may share any information you submit on or to the Site when it has your consent to do so. We do not share, sell, lend or lease any of the information that uniquely identify a User and Customer or subscriber (such as email addresses or personal details) with anyone except to the extent it is necessary to process transactions or provide services that you have requested. Notwithstanding the above policies, we reserve the right to disclose your Personal Information to appropriate third parties if we are required to do so by law or We believe that such action is necessary: to comply with legal process such as a search warrant or court order; to protect against misuse or unauthorised use of Our Site. TrackN may also share or disclose information, where necessary, to legal and other professional advisers, TrackN ’s related companies and other business support providers, including document storage, printing and collating companies. Marketing We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalise our services, content and advertising. If you don't wish to receive marketing communications from us or participate in our ad-management programs, simply indicate your preference in your account profile on your personal site or by following the directions provided with the communication or advertisement. External Service Providers There are a number of services offered by external service providers that help you use our Site such PayPal Pro; providers for website host, SMS serving, autoresponder, positioning, translations etc. If you use these services, and in the course of doing so, disclose information to the external service providers, and/or grant them permission to collect information about you, then their use of your information is governed by their privacy policy. We may, for your convenience, provide some of your Personal Information to the external service provider offering such services. However, before we disclose your Personal Information to an external service provider, you will see what data is about to be sent and have the ability to approve the disclosure. To prevent our disclosure of your Personal Information to an external service provider, you can decline such disclosures or simply not use their services. Because we do not control the privacy practices of these third parties, you should evaluate their practices before deciding to use their services. TrackN has developed Mobile phone clients such as Apple (iPhone), RIM (Blackberry), use of Microsoft Gold Partner (Windows Mobile) and Symbian (Nokia) in accordance with the manufacturer’s guidelines. These Mobile phone clients can only access user positions via their phone devices. Internal Service Providers We may use internal service providers to facilitate our services (e.g., search, discussion boards, surveys) and therefore we may provide some of your Personal Information directly to them. In some instances, the internal service provider may collect information directly from you (such as the situation where we ask a internal service provider to conduct a survey for us). In these cases, you will be notified of the involvement of the internal service provider, and all information disclosures you make will be strictly optional. In all cases, these internal service providers' use of information we supply them is restricted by confidentiality agreements. If you provide additional information to an internal service provider directly, then their use of your information is governed by their applicable privacy policy. Other Corporate Entities We share much of our data, including Personal Information about you, with our parent, external affiliate resellers, subsidiaries and joint ventures that are committed to serving your online needs and related services. Should such a combination occur, you should expect that TrackN would share some or all of your information in order to continue to provide the service. You will receive notice of such event (to the extent it occurs) we will require that the new combined entity follow the practices disclosed in this Privacy Policy. Your Use of Other User and Customer s' Information By accepting this Privacy Policy, you agree that, with respect to other User and Customer s' Personal Information that you obtain through the Site or through a TrackN -related communication. TrackN hereby grants to you a licence to use such information only for using services offered through TrackN. Links You should be aware that when you are on this Site, you could be directed to other sites that are beyond our control. There are links to other sites from Site pages that take you outside our service. For example, if you "click" on a banner advertisement or a "referral link to another site", the "click" takes you off the Site. This includes links from some advertisers, site sponsors and partners that may use Site’s logo as part of a co-branding agreement. These other sites may send their own cookies to Users, collect data or solicit personal information. The Site is not responsible for the privacy policies and/ or practices on other sites. When linking to another site a User should read the privacy policy stated on that site. This Privacy Policy only applies to information collect by the Site. Message/Bulletin Boards, Blogs, and Forums Please be aware whenever you voluntarily post public information to Message Boards, Blogs, and Forums that the information can be accessed by the public and used by those people to send you unsolicited messages. We shall not be held liable or responsible for any adverse claims thereto. Q&A Session We offer a unique Question and Answer (‘Q&A’) feature on the Site so that users can interact with TrackN for query handling and troubleshooting. During the session, a user enters into question and answer session with an online representative of TrackN. We maintain dialogue transcripts of these sessions. We access the information we collect for certain purposes including, but not limited to, the following: to provide maintenance, support or professional services to our users, to aggregate the information, to monitor the use of the service during certain chats/question and answer sessions and for other lawful purposes. Your Consent By using our Site you consent to our collection and use of your personal information as described in this Privacy Policy. We reserve the right to amend this privacy policy at any time with or without notice. Data Security TrackN has established company-wide security practices for your protection. These practices include, but are not limited to, firewall security, the use of appropriate encryption technology, and the use of multiple levels of password security to limit access to data on a "need-to-know" basis. We may use contractors or vendors to help us provide some of the services at our site. If we disclose personal information for them to provide the services, it is with the requirement that the information is kept confidential and used only for those services. All contractors and employees are required to familiarise themselves with, and abide by, these safeguards. We will not be transferring your personal information outside of the European Economic Area unless otherwise specifically advised. Accessing and Updating Your Personal Information and Preferences We provide mechanisms for updating and correcting your personal information for many of our services. You may modify or remove any of your personal information at any time by logging into your account and accessing features such as edit and account. Privacy Control Children are not eligible to use our services unsupervised and we ask that children (under the age of 16 ) do not submit any personal information to us. If you are a minor, you can use this service only in conjunction with permission and guidance from your parents or guardians. Acquisition or Changes in Ownership In the event that the Site (or a substantial portion of its assets) is acquired, your information would be considered part of those assets, and may be part of those assets that are transferred.
